A middle-aged man with a benign brain tumor that had enlarged over a year or two had surgery to remove the tumor. The neurosurgeon used a new guidance system device to map the brain and assist him in locating the tumor in the operation.

Instead of reaching the tumor to remove it during the operation, however, it was alleged that the guidance system led the surgeon to a different, healthy area of the brain that was in a critical location. The result was that the patient was left with a quarter-sized hole in a healthy part of his brain that involved motor and memory functions. So, he suffered a moderate brain injury, and stroke-like damage; and, the benign tumor was never taken out. Two women went to eat at a chain restaurant, and they shared appetizers and ordered similar entrees. Both were sick the next morning, and while one recovered, the other’s condition became critical.

She was hospitalized and tests confirmed a food-poisoning related bacteria that severely damaged her kidneys, eventually requiring a kidney transplant. A middle-aged contractor in an oil-refinery was repeatedly and unknowingly exposed to high levels of benzene, and he developed leukemia (blood cancer) following retirement.

Despite various federal and state laws that help protect gyms and other facilities from lawsuits if they properly train staff on, and use, automated external defibrillators (AEDs) for people suffering cardiac arrest, some gyms still go without these life-saving devices or, even worse, purchase one and then never train staff how to use it.

But by the time EMS arrived and used the machine to restore the man’s heart, over ten minutes had elapsed, and he suffered very severe brain damage from lack of oxygenated blood flow during that time.
