A young woman with neck pain due to a herniated disc, who also had a mild spinal malalignment (known as mild kyphosis/scoliosis) underwent major surgery to correct the conditions.

After the surgery she had severe neck/back weakness, pain, and life-long physical limitations. It was alleged that only the vertebral disc surgery or a limited fusion was necessary, not extensive surgery involving multiple spinal fusions and surgical instrumentation being placed on the spine. A young mother was admitted to a hospital for delivery of her baby at term. Although there were no major problems during pregnancy, the electronic fetal monitor (EFM) strip began showing that the baby was having problems during the mother's labor.

As the labor progressed, so did the worsening of the EFM strip.
