Failure to Use Appropriate Pressure & Maneuvers in Delivery/Nerve Damage


A baby was born in with a severe brachial plexus injury after shoulder dystocia was encountered during the hospital delivery. The child had evidence of a brachial plexus nerve that was torn into (avulsion) and was significantly and permanently disabled in the use of its hand/arm as a result. It was alleged that the delivering doctor did not use proper maneuvers to alleviate the shoulder dystocia, and that excessive and improper pressure was used by the doctor and nurse to deliver the baby. With the assistance of co-counsel, the case was prosecuted and ultimately settled confidentially in by Clore Law Group, LLC in favor of the parents and child.
