The South Carolina Highway Patrol reported on April 13, 2011 that one person died and another was injured after a three-car accident in North Charleston Wednesday afternoon. According to investigators, the man was pulling out of a parking lot in his Honda car when he was struck by an SUV. The man's car was then pushed into oncoming traffic and was hit by a pickup truck. Authorities say a 60-year-old man died after the accident on Ashley Phosphate Road near Saddlebrook Drive. The driver of the SUV was taken to MUSC with unknown injuries while the driver of the truck was not injured. Authorities say the driver of the Honda was at fault. When a Charleston car accident like this occurs, a standard of care is applied to determine negligence in a personal injury lawsuit.

Charleston Car Accident: Duty of Care

Charleston car accident lawsuits generally focus on whether the other person had a duty of care and used care while driving his or her vehicle. A particular standard of care must be met when operating a car. To meet this standard or duty of care, drivers must:

  • Operate the vehicle at a reasonable rate of speed
  • Keep the vehicle under proper control
  • Look out for all situations that could result in an accident
  • Additionally, auto accident lawsuits in South Carolina also focus on whether the other driver's actions created an unreasonable risk. Generally, if a risk can be reasonably anticipated, it must be avoided.
