Improper Traction to Fetal Head During Delivery
A baby was born following shoulder dystocia with a severe injury to the brachial plexus, and radiology imaging later showed that brachial nerve(s) had been torn away (avulsed). As a result, the child had significantly and permanently limited use of her arm/hand affected by the nerve damage. It was alleged among other things that the physician-resident who delivered the child in the hospital did so inappropriately, and with excessive traction, thereby causing the damage. A case was prosecuted, and a confidential settlement for the parents and child was ultimately obtained, by Clore Law Group, LLC.
