Recent Supreme Court ruling protects victims’ rights to contest government liens

Wos v. E.M.A.

In a ruling handed down March 19, 2013, the Supreme Court struck down a North Carolina law that set a fixed lien on awards to Medicaid recipients. North Carolina had a law in place to take one-third of all the money Medicaid claimants get in suits against doctors and hospitals, but the Supreme Court rejected North Carolina's fixed rule, directing that North Carolina instead set up a process that decides in each case how much of the money is for medical expenses (which the state gets) and how much is for other damages such as pain and suffering (which the claimant gets to keep).
