The following article appeared recently regarding a fatal DUI that may be cause for a wrongful death lawsuit. ORANGEBURG COUNTY, SC (WIS) - One person was killed in an accident Monday evening and a driver is under arrest for driving under the influence, according to the South Carolina Highway Patrol. Troopers said 29-year-old Wayne Mitchell was driving a 2011 Nissan with two passengers around 6:30 p.m. when he collided with another car on US 178 near Bowman. After the two cars collided, Mitchell's Nissan rolled several times. 38-year-old Al Lucas, a passenger in the Nissan, was killed as a result of injuries sustained during the crash, according to the Orangeburg County Coroner's Office. Troopers said Lucas was wearing a seatbelt. A second passenger was not injured. The Highway Patrol isn't saying what caused the accident, but they say both cars were heading west on US 178. Mitchell was taken to the Orangeburg-Calhoun Regional Detention Center on driving under the influence and driving under suspension charges. Troopers said it is not clear if Mitchell was to blame for causing the accident. The driver of the second car was taken to the Regional Medical Center in Orangeburg for his injuries. Wrongful Death from Car Accidents

Car accidents involving drunk driving are often followed by a wrongful death lawsuit. The death of the passenger may increase the charge to felony DUI, but that is a criminal charge. It could result in jail for the accused, but it offers nothing to the families of those killed by another person's negligent actions. This is the reason for the civil lawsuit, known as wrongful death. As we saw with the OJ Simpson case, the criminal charges and civil lawsuit are separate. It is possible to found innocent of one and negligent in the other. More times than not, a criminal conviction will indicate a wrongful death lawsuit will be victorious. The purpose of wrongful death damages is to compensate the victims family for the funeral expenses, loss of future wages and pain and suffering. The accused's auto insurance will cover this claim, but damages can exceed coverage. In such an event, a skilled wrongful death lawyer will seek the additional damages from the insurance company, the accused or a third party.
